Ethereum ETFs - Why This is Different Than Bitcoin ETF's...

Late yesterday the Securities and Exchange Commission (SEC) officially approved Ethereum spot exchange-traded funds (ETFs) to begin trading today! Following in Bitcoin's footsteps, the world's second-largest cryptocurrency will now be accessible to investors through traditional markets.

Here's the list of the newly approved Ethereum ETFs and where you can find them:

  • Grayscale Ethereum Mini Trust (ETH) - New York Stock Exchange
  • Franklin Ethereum ETF (EZET) - CBOE Exchange
  • VanEck Ethereum ETF (ETHV) - CBOE Exchange
  • Bitwise Ethereum ETF (ETHW) - New York Stock Exchange
  • 21Shares Core Ethereum ETF (CETH) - CBOE Exchange
  • Fidelity Ethereum Fund (FETH) - CBOE Exchange
  • iShares Ethereum Trust (ETHA) - Nasdaq
  • Invesco Galaxy Ethereum ETF (QETH) - CBOE Exchange

In addition to these, the SEC has also given the green light for Grayscale to convert its Grayscale Ethereum Trust (ETHE) to a spot ETF, which is a big deal for those tracking crypto investments.

For those of you who are new to ETFs, or exchange-traded fund, is an investment fund that owns the underlying asset it representsin this case, Ethereum. When you buy shares of an Ethereum ETF, you are essentially buying a portion of the Ethereum owned by the ETF, which is managed by a financial company. This way, you can invest in Ethereum without needing to buy, store, or manage the cryptocurrency yourself.

Major BULL RUN Coming?!

What caught my eye is when looking back to May when the SEC approved Ethereum ETFs (said they will allow them, but did not yet have a launch date) Ethereum made some gains but, but there were multiple positive news stories that month, mainly US traders receiving conformation ETH 2.0 will not be viewed as a Security, and Ethereum's gains in May were mostly credited to news that US exchanges wouldn't have to de-list it.

When Bitcoin ETF's received the same approval investors responded in such large numbers it was actually credited with brining back the bull market. So by the time Bitcoin ETF's launched, most investors reacting to the news did so days/weeks earlier. This also likely had investors assuming 

I don't make price predictions, but I will make a suggestion that you take a look - when the market doesn't react to the announcement, it often means it will react to the launch. 

Those offering the ETH ETF are mostly the same companies that already offer the Bitcoin ETF, and they've done quite well, bringing in hundreds of millions of dollars.  They will now promote the ETH ETF to those same investors - and selling a token via an ETF requires the company to actually buy and own the asset. 

So, just something to consider.

Trump Says He's the "Crypto President"...

Former president Donald Trump continues to repeat his stance as the crypto-friendly candidate, and it's resulting in votes and donations from the tech world.

Trump has seen the light. 5 years ago the former President was saying crypto was a disaster waiting to happen but since then has made a number of pro-crypto statements. 

Trevor Traina, ambassador to Austria during the Trump Administration and current tech executive, tells Reuters that Trump said he would be the crypto president at a recent San Francisco fundraiser.

Unexpected Support in 'Liberal' Silicon Valley

As someone in Silicon Valley, I never expected to hear that Trump was in San Francisco, raising millions from the tech elite that were clearly against him in the previous two elections.

But just three days ago, Silicon Valley venture capitalists David Sacks and Chamath Palihapitiya hosted the former president at Sacks' mansion in the wealthy Pacific Heights neighborhood, where Trump gave a speech, followed by a dinner and reception. The tickets started at $50,000, and the event sold out, ending in $12 million being raised for the campaign.

Trump Arriving in San Francisco earlier this week.

Crypto is among a list of policies that have 'turned off' those now supporting Trump in a city that voted 85% for Biden.

All Happening While Biden's Administration Continues to Advocate Policies that Aren't Just Bad for Crypto - They Expose a Complete Lack of Understanding of How Crypto Works

For example, the first crypto-related proposals exposed that the Biden administration viewed wallet providers the same as banks, saying they should be required to verify the identities of all users. In reality, wallets are simply software that runs entirely on the user's end, different from a bank in every possible way.

The creator of a legitimate crypto wallet is both blind and powerless when it comes to who uses it and what those users are doing. They cannot help the government seize someone's crypto, even with a warrant, because they literally cannot access it. They also cannot prevent anyone from using the wallet they created - if the file to install it is accessible, anyone can use it.

In other words, it is both completely pointless to require wallet creators to demand information from users they have no authority over, and there is no reason for users to comply when ignoring these new requirements has the same end result - them being free to continue using whatever wallet they want.

No one can be surprised that the industry rightfully fears the end result of people writing new laws intended to regulate something they clearly do not understand.

As Trump Warmed Up To Crypto, His Campaign Made Sure to Show It

In 2022, the announcement that he would be running again came with the launch of Trump NFTs on the Ethereum-based platform OpenSea.

In 2023, his financial disclosure filed with the Office of Government Ethics included a crypto wallet with up to $500,000 worth of assets in it - this wallet's value recently broke $5 million in value. Since the wallet address became known, both random users and projects have gifted or airdropped coins to it.

Then last month, his campaign announced they will accept crypto donations for the 2024 election.

There are Legitimate Reasons Any US Leader Should Support Crypto

One major contributing factor to the US's global power is the strength of the US dollar, and one major reason the dollar is so strong is its status as the global 'reserve currency' as well as the official standard currency for purchasing oil from the world's largest supplier - OPEC in the Middle East.

When the global economy is in turmoil, as seen recently during the COVID pandemic, many nations converted their treasury to US dollars. The Federal Reserve was overwhelmed initially, having to scramble to fulfill other countries central banks' demands for what is seen as the world's most stable currency.

That word 'stable' is one crypto investors are familiar with - as the US dollar is finding yet another market where it has become the standard for investors looking for a stable currency to both cash out and re-enter trades from.

In fact, when it comes to cryptocurrencies tied to standard fiat money, the top 16 stablecoins are all based on the US dollar, with 'STASIS EURO' at #17 and less than $1 million in daily transactions. The top stablecoin USDT has done $39 billion in the same 24-hour time period.

While the crypto market trades digital versions, the two that account for the overwhelming majority of stablecoin transactions, USDT and USDC, are both publicly audited companies that verify they hold the money to back up the coin. This means as we've watched stablecoin usage skyrocket over the last few years, offline this created new real-world demand for US dollars.

You would think this would result in crypto having no effect on the election, as both sides would support its continued growth. Regardless of what your opinions may be on other issues - it's a fact that only one candidate seems to be getting this one right.

FTX Users To Receive 112% BACK, FTX Claims BILLIONS MORE "Left Over"...

This story somehow never runs out of surprising twists, and this one is massive.

Look back on almost any news coverage, or old posts in online crypto communities made by your average trader - in everyone's mind this was a story about people losing billions.  At one point it was probably true, when the market had just been hit with the Terra/Luna collapse There's no downplaying how much this story changes when it no longer involves anyone losing money.

At one point, every FTX user who had funds sitting on the exchange when it shut down believed they had lost money, with many expecting to hear all of it was gone. 

Searching old posts in online crypto communities made at the time FTX halted trading show there was little hope they would recover any funds they left in FTX controlled wallets.

Now we finally know how the story ends for the users of FTX - they're getting all of it back, and then some.

FTX Owes $11.2 Billion - All of That and More is Ready to Be Paid Out Immediately...

Under new leadership following FTXs bankruptcy claim and the arrests of its former executives, liquidation of company assets began. This involved mainly dumping massive amounts of crypto over the last few months, enough where the $11.2 billion owed already sits in US dollars they can access anytime. But theres more to come, as they claim to still have another $2+ billion in crypto that cannot yet be sold.

Sam participated in a common practice among VCs where projects offer them a chance to invest early by buying coins at an extremely low price. However, these coins are 'locked' and unable to be traded until a future date.

The biggest chunk of FTX's recent windfall of cash comes from Sam's early investment into Solana, where hes rumored to have paid 0.20 cents per coin - theyre worth $133 each today, but FTX's bankruptcy team supposedly dumped a large amount when it was trading closer to $200.

Solana was the largest source of funds, worth billions, but FTX held millions of dollars worth of dozens of other coins, selling these off totaled several more billion dollars.

The end result - FTX can pay back all users right now, with a little extra. 

Sam and His Supporters Say This Changes Everything... 

According to his family, Sam is in prison wrongly labeled as someone who caused investors to lose billions. Now that the trial and sentencing are done, we learn no one lost anything, and they're even walking away with a small profit - this is a completely different situation than what he was sent to prison for.

32-year-old Sam is serving a sentence of 25 years, the prime of his life wasted - this is a punishment designed for someone who caused countless people to lose their hard earned money. 

He'll be 57 when released, that is if he survives prison, as his family says his 'social awkwardness' puts him at high risk of becoming the victim of 'extreme violence' from another inmate confusing Sam's awkwardness for rudeness. His cellmate from the NY jail that held Sam during the trial says there were times other inmates indeed targeted him.

Before Sentencing, The Judge Allowed Some FTX Users To Share Stories of How Their Lives Were Ruined...

At the time, the final outcome was still unknown. These users gave stories of their lives being ruined, stating things like "decades worth of savings" were gone forever because of Sam's actions.

These were the kind of stories the judge heard right before sentencing Sam to 25 years in prison.

It does make you wonder - would the sentence be different if these former FTX users only had stories of their funds being inaccessible, then eventually getting all of it back, with a small profit? Honestly, I have a hard time believing it wouldn't.

But Maybe This Shouldn't Change Anything...

Let's imagine the worst-case scenario. Sam, like everyone else, cannot actually predict the future. While his early investments into projects like Solana are bringing in billions in profits today, things also could have gone the other way.

You can say he made smart investments that paid off, as he knew they would, so from his point of view no user funds were ever at risk. But there's just some things he couldn't have known no matter how much research he put into his decisions. For example, what if Solana faced a massive hack? We've seen hacks ruin projects that had the potential to end up among the top 10 tokens - no one can predict the discovery of a new security vulnerability.

If an unforeseen hack did bring down Solana, this would be a story of FTX billions short on what they owe.

So, while things end with no one losing money, Sam did, in fact, gamble with user funds and expose them to potentially losing all of it.

On that note, while he was risking other people's money, did he plan to share the rewards if it all worked out? Of course not. Sam quietly 'borrowed' user funds without them knowing, he would have taken the profits and return what he had borrowed just as quietly as he took it.

We've all Been Damaged By Sam's Actions...

I was not an FTX user, but that didn't matter as we all watched our portfolios go into a nosedive the day FTX halted trading, and those losses weren't recouped for over a year.

But what many are unaware of is that the damages actually continue to the present day. The reason FTX has so much money right now because they dumped their massive stash of coins on the market over the last year, often at times the market was on the rise, bringing that rise to a halt.

In fact, FTX is the reason why we saw Bitcoin ETFs bringing billions of new investments into the market, and the price of Bitcoin barely move. Sam had purchased shares of Grayscale's Bitcoin Trust which automatically was converted into shares of Grayscale's ETF, so when the ETF went live FTX had 22 million shares of it - which they immediately dumped onto the market.

But it was FTX's Solana holdings that became worth billions while Sam was on trial - there's no way to know what Solana's price would be today if FTX hadn't dumped billions of dollars worth - but higher for sure, possibly much higher.

Fact is - Sam is a Liar...

Ironically, his largest broken promise is in print, on one of Sam's strangest marketing decisions.


The FTX condoms that read Never breaks...even during large liquidations" - ironically describing the exact conditions that would indeed break FTX.  

In Closing...

This is all still sinking in, but when I think about Sam being in prison right now, it feels justified. He deserves some punishment.  Where I'm torn is if in 15 or 20 years from now, I'll feel like it's justified that he's still there. 

From a legal standpoint, the end result of a crime usually makes a massive difference.  For example, imagine someone driving the wrong way on a freeway because they're extremely drunk, and they manage not to kill anyone only because the other drivers swerved to avoid them. Then imagine the same scenario but in this one, the drunk driver kills an innocent driver in a head on collision.  Even though we're fully aware that both literally made the exact same poor choices - one could end up in prison for a few months, and the other for decades.

Ultimately, the choices Sam made led him here, making it hard to feel sorry for him now. So while I won't be campaigning to #FreeSam, I also wouldn't be angry to hear Sam's legal team was able to have the sentence re-evaluated, and reduced by a few years.

UK Courts Have Had ENOUGH Of Craig Wright - Judge Closes Case, Says Wright's Evidence 'Fabricated'...

It's over for the infamous Craig Wright, one of Bitcoin's early developers who actually did work with Bitcoin inventor Satoshi Nakamoto, then in recent years begun to claim he was Satoshi himself.

 A ruling by a High Court judge in London on Monday (May 20) determined that the Australian computer scientist Craig Wright provided false testimony and fabricated documents to substantiate his unsubstantiated assertion of being the inventor of bitcoin.

Judge James Mellor, in a decision rendered in March and with reasons outlined on Monday as reported by Reuters, concluded that the evidence did not support Wright's claim to be the pseudonymous "Satoshi Nakamoto" behind bitcoin's creation. The judge found that Wright had been deceitful and had forged documentation to bolster his inventor claim, and that Wright's legal actions against bitcoin developers as well as his expressed views on bitcoin contradicted his purported status.

Developers Feel Relief Following Ruling...

Wright's legal attempt, had it succeeded, would have given him the right to sue anyone who built anything on Bitcoin's network, as he would become the copyright holder to Bitcoin's code.

In a blog post on Monday following the ruling, a Crypto Open Patent Alliance (COPA) spokesperson said that the judgment "forensically demolishes Wright's fraudulent claims."

"This decision is a watershed moment for the open-source community and even more importantly, a definitive win for the truth," a COPA spokesperson said. "Developers can now continue their important work maintaining, iterating on and improving the bitcoin network without risking their personal livelihoods or fearing costly and time-consuming litigation from Craig Wright."

Wright Vows To Appeal...

On X (formerly Twitter), Wright stated on Monday: "I fully intend to appeal the decision of the court on the matter of the identity issue. I would like to acknowledge and thank all my supporters for their unwavering encouragement and support."

Wright first came forward with his claim to be bitcoin's creator in May 2016, making the assertion to three publications the BBC, The Economist, and GQ and sending digitally signed messages using cryptographic keys created during bitcoin's early development days.

"These are the blocks used to send 10 bitcoins to Hal Finney in January [2009] as the first bitcoin transaction," Wright stated at the time during his demonstration.

However, by December 2019, when a Florida judge ruled that Wright's late partner was entitled to half of the bitcoins Wright mined through 2013 and half of the related intellectual property, some crypto experts were skeptical of Wright's claims, viewing them as fraudulent.

How Geopolitical Tensions Effect Maekets...

The price of Bitcoin has plummeted more than 7.5% in the last 24 hours, plunging to around $62,000 on several major exchanges.

At the time of this publication, Bitcoin is trading at approximately $64,300 per unit.

Bitcoin's downfall was not an isolated event. The S&P 500 index, which comprises the largest American companies, also experienced a significant decline in the past week, accentuated on the last business day. The same occurred with markets in other countries, indicating a global market reaction.

The primary apparent reason for these market movements is the escalating tensions in the Middle East, specifically the conflict in Israel and the potential for a larger-scale conflict brewing, as Iran has launched attacks.

What Could Reverse the Trend?

The imminent approval of Bitcoin ETFs in Hong Kong, one of the world's five largest financial markets, could be a turning point. The impact of such a measure would be substantial, as it could potentially influence the Chinese government to relax restrictions on the use of digital assets.

Additionally, the next Bitcoin halving event, which reduces the issuance of BTC per mined block by half, is just days away. This event typically generates significant media attention and visibility for Bitcoin, serving as a remarkable marketing opportunity.

Furthermore, each halving reminds the market that Bitcoin is a scarce asset and that the available quantity for acquisition will become increasingly limited, which has historically acted as an upward catalyst for its price in the medium and long term.

Terraform Founder Do Kwon sits in 'Dangerous and Overcrowded' Montengro Prison....

Do Kwon, the founder of the now-defunct Terra USD (UST) and Luna (LUNA) cryptocurrencies, could face up to five years in a Montenegrin prison before being extradited to South Korea or the United States.

Kwon is currently under quarantine for COVID-19 and will soon be sharing a cell with other inmates in a Montenegrin prison, according to a report by a local lawyer.

Montenegro Prisons a 'Hell On Earth'...However, the prisons in Montenegro are notoriously overcrowded, and inmates are often subjected to aggressive treatment by prison staff.

Amnesty International has raised concerns about the conditions and rights of detainees in Montenegrin prisons, including the lack of independent investigations into ill-treatment.

The cell Kwon will be occupying is only 8 square meters and is usually filled with between 10 and 11 people, leaving no room for a bed.

Inmates are only allowed a 30-minute walk in the prison yard each day and can only purchase limited items like cigarettes and coffee.

Montenegro now the first of 3 nations that will need to take turns locking up Kwon...

Kwon's initial arrest in Montenegro was due to presenting false documents, is a crime that carries a penalty of up to five years.

While both South Korea and the United States have requested Kwon's extradition, Montenegro has yet to make a decision.

If Montenegro decides to pursue it, this could be the first of three nations aiming for him to serve time in their prisons.

Here we will review those attempts, knowing that ultimately in the end, they failed. 

Sam's Parents Fear His Social Awkwardness Puts him in 'Extreme Danger' in a Prison Environment...

Sam's family made a desperate plea to the judge, begging for leniency in his sentencing for the FTX cryptocurrency fraud case. His parents, Barbara Fried and Joseph Bankman, warned that their son's social awkwardness and inability to read social cues could put him in "extreme danger" behind bars, fearing for his life in a typical prison environment.

In a heartfelt letter, Barbara Fried described her son's touching but naive belief in the power of facts and reason, arguing that his outward presentation and misinterpretation of social cues could lead to potentially disastrous situations with fellow inmates. Joseph Bankman echoed these concerns, cautioning that his son's "odd" social responses could be misconstrued as disrespect or evasion, putting him at significant physical risk.

Also included, a letter from Sam's current jail bunkmate, a former NYPD officer arrested after being caught soliciting underage teens for explicit images on twitter, calling Sam the 'least intimidating person here' which has led to other inmates targeting him for harassment. 

Lawyers Argue for a DRASTICALLY Shorter Sentence...

With the value of crypto increasing, it appears the FTX's holdings are worth enough to fully cover everything owed to customers.

Focused on this new factor, Bankman-Fried's legal team also made an effort to secure a lighter sentence, arguing for a prison term of no longer than 78 months, or 6 ½ years. They say the trial largely revolved around the story of a rogue, careless CEO whos actions caused his customers to lose billions.

However, this argument inspired the team handling the FTX bankruptcy to write a letter to the judge, where they say removing Sam is the only thing that stopped the bleeding, and that he deserves no credit for the company's ability to pay users back today, because at the time he was spending customers money without their knowledge, he was gambling, and easily could have lost it all.  

In the End, All Attempts for a Lighter Sentence FAILED...

All hopes for leniency were shattered when U.S. District Judge Lewis Kaplan handed down a 25-year sentence for Bankman-Fried's role in the fraud that led to the collapse of FTX. Judge Kaplan firmly rejected Bankman-Fried's statements from the trial when he took the stand in his own defense,  accusing him of lying during his testimony.

"He knew it was wrong," Kaplan said, "He knew it was criminal. He regrets that he made a very bad bet about the likelihood of getting caught. But he is not going to admit a thing, as is his right."

Bankman-Fried was taken away by US Marshalls to begin his 25-year sentence - now living out the worst fears expressed by his concerned parents.

In conclusion...

It's expected that Sam's legal team will appeal, his parents stating they will "continue to fight" for their son, but the odds of that succeeding would be extremely low without some major new information coming to light.  

While Sam and his family may find it hard to find anything positive in how things ended, it's worth noting that his crimes gave the judge the option of sentencing him for up to 110 years in prison. While Sam's family and lawyers argued for a much shorter 6 years, getting 25 seems like a huge defeat - but compare to 110 years it seems the judge was still fairly lenient.

Sam will probably be free again, at 57 years old. It's widely believed that Sam has a secret stash of Bitcoin tucked away in a wallet no one knows belongs to him - what do you think the price of BTC will be in 2049?

Rising CONFLICT Over the 'Digital Dollar', As Some States BAN IT Before It Even Exists...

The battle for the future of money is heating up in the United States, with some states proposing to ban the "digital dollar" before it even exists, while others quietly pass laws to make it a reality. It's a conflict that has raised concerns about privacy, surveillance, and control.

Florida Governor Ron DeSantis is leading the charge against the digital dollar, announcing a proposed bill to ban it in his state. According to a statement from the governor's office, the legislation is intended to "protect Floridians from the Biden administration's use of financial sector weapons through a central bank digital currency (CBDC)."

DeSantis's bill seeks to prohibit the use of the digital dollar or CBDC as money in Florida and to create "protections" against digital currencies issued by central banks belonging to nations sanctioned by the United States. He hopes that other states will follow suit and establish similar prohibitions to "fight this concept throughout the country."

In the view of the Republican governor, a digital currency "has to do with surveillance and control" of citizens, and it "will stifle innovation." adding that "Florida will not side with the economic central planners. "We will not adopt policies that threaten economic freedom and personal security."

Senator Ted Cruz of Texas is also pushing for a ban on the digital dollar, citing concerns about privacy implications. He argues that a digital dollar "could be used as a financial surveillance tool by the federal government."

As Other States Quietly Take Steps to Move the Digital Dollar Forward...

President Biden issued an executive order last year that instructs several government offices to research creating a central bank digital currency, since then things have appeared to be moving forward with no official updates from the federal government.

The silence seems to be deliberate when it comes to the most recent steps targeting the Uniform Commercial Code (UCC), which are laws that every state has, and every state controls. 

Intended to make sure states can easily conduct business with each other, the digital dollar may be the first time there's been major disagreements between some states and could result in the 'Uniform' codes ending up far from uniform nation-wide. 

Just this week South Dakota Governor Kristi Noem vetoed House Bill 1193 which would have opened the doors for the digital dollar in her state by amending their UCC to allow for fully electronic payments backed only by electronic records "this is extremely troubling. If Congress were to someday create an official electronic currency that is programmable, it would pose significant threats to Americans’ liberty and privacy rights. Why, then, would so many lawmakers want to make it easier for such a currency to be used in their states?"

Both republicans and democrats have made more public statements implying they are against the digital dollar, yet both parties have been found slipping the verbiage needed to make it happen into bills in their states, now there are similar bills headed to vote soon in 20 more states including in Arkansas, Montana, New Hampshire, North Dakota, Tennessee, Texas, and California.

One Major Roadblock Could Still Stop the Digital Dollar from Happening...

Not because they share any of the same concerns citizens have voiced - but nonetheless, they hate the idea and they may have enough power over politicians to get their way - the banks.

Banks see the Digital Dollar as a way for the government to become their biggest competitor.  Imagine - your job pays you in digital dollars, they're stored in an app on your phone, and virtually every place you would spend money accepts it, what do you need a bank for? 

While banks would still have a role when it comes to investing, lending, and securing larger business and personal accounts, the average person could go months, or even years without needing to interact with a bank, and have no need for a personal account. 
A battle with significant consequences...

Both for the future of our economy and the role of the government in our financial lives. Will we become a cashless society dominated by a digital dollar, or will we maintain the status quo? 

Until recently, this all felt like something so far in the future it was hard to really concern yourself with - but as we begin seeing real laws designed to move plans for the digital dollar forward proposed in multiple states, the potential implications are beginning to feel very real.

Russian Darknet Market HACKED, Bitcoin Taken... Transferred to Ukraine!

Computer Security specialist Alex Holden was born in Ukraine, and while he now lives in the United States, he's doing what he can to help his countries efforts against Russia. 

Holden is sharing his accomplishment of infiltrating Russia's largest online drug market, called Solaris, steal 1.6 bitcoin (BTC) from the website's main wallet, and donate it to Ukraine.

The funds were sent to a Ukrainian non-profit called 'Enjoying Life", and the organizations co-founder Tina Mikhailovskaya confirms it was received, saying it was "given directly to the elderly, families and internally displaced people who suffered from the Russian war."

Holden declined to tell how he did the robbery, only sharing that it involved help from his team of hackers from he employs at his company Hold Security, and that they took 'partial control of the Solaris infrastructure' which somehow included access to the wallet. 

While an amusing story, this is small compare to the true impact of crypto on this war...

Ukraine is the first nation in history to formally accept bitcoin and other cryptocurrencies to finance the costs of a war, and so far their wallet has received 645 BTC in donations from around the world. That is equivalent to $10 million USD at current rates, and $45 million at Bitcoin's high.

What Took so Long for Sam Bankman-Fried to Face CRIMINAL CHARGES?

While watching Sam Bankman-Fried's recent media appearances, a theory entered my head - a gut feeling, but a strong one saying "He's been told he has nothing to worry about" and the more I listened with this theory in mind, the more convinced I became. 

Take a look for yourself and tell me if you see a man in fear of spending years in a federal prison - I don't think anyone could hide how stressful that possibility would be, but at no point did Sam show he was feeling any significant amount of stress. Not in some delusional way either - I don't believe his lack of stress comes from him being detached from reality, pretending everything is fine.

What I do see, is someone who believes the worst case scenario isn't going to happen...

These interviews seem like nothing more than an attempt to salvage his public image.   His strategy is more obvious than he seems to be aware of, as uses a classic pity-educing method of 'beating himself up', expressing regret, and taking some blame... but not too much. 

When it comes to blame, he seems to think he found the magic ratio of blame to excuses, as anytime he takes responsibility for doing something wrong, it comes with a reminder that he would never had made these mistakes if he knew the details of Alameda Research's trading positions at the time.

Even if we were to believe he wasn't pro-actively staying up-to-date on the business of Alameda Research, staying completely in the dark would actually be hard to do as the people operating Alameda literally live with him.

While it was met with disbelief every time he said it, he remained firm on not knowing vital details about Alameda Research, even though it is a company he created, that he has majority ownership of, and is holding a massive amount of the funds from investors he brought in.  I doubt his pitch to investors was 'put a few million in to this company, which I have nothing to do with'. 

My point is, he isn't making these public appearances to claim innocence, or even explain what happened. He's making them with the goal of getting people to say "Sam's a good guy who just made some mistakes".

I can't help but think that the only way being liked becomes more important than being free, is if he's already convinced his freedom isn't at risk.

But in order to objective, i'm open to the possibility that I'm just misreading him.  So I set aside any of my own opinions and 'gut feelings' and re-examined the situation strictly looking at the facts to see if I come to the same conclusion in the end.

Starting with some things worth a deeper look.

Sam's parents are not typical lawyers, and after learning more about them I think it's time to question how involved in FTX Sam's parents may be... 

Those who graduate from Stanford law school are considered among the top of the legal field - so you can imagine what it takes to be hired to teach those students - both of Sam's parents worked as Stanford Law professors. 

What kind of law do they specialize in? The kind that someone in Sam's position would be hiring right now.

The mother worked at Paul Weiss, one of the top firms in the US with clients like Exxon, JPMorgan, Citigroup, Universal Pictures, Sony and more. She is one of the founders of a "secretive Silicon Valley PAC that supports Democratic candidates" called Mind The Gap. 

Sam's father is considered one of the leading experts in tax law, tax shelters, and tax compliance, according to his Stanford bio page. I found this video uploaded by Stanford Law School featuring him speaking on the topic.

In other words, Sam Bankman-Fried was born with the perfect legal team already in the room.

If anyone could make sure Sam's actions stayed within legal grey areas or completely unenforceable by US regulators, it's them.

On this note, Sam has repeated in every interview that none of these questionable actions were done with funds from the US version of FTX. There indeed was a completely separate site for US investors, and if someone from the US tried to access the FTX for the rest of the world, they would find themselves blocked from signing up.

Sam remaining in the Bahamas doesn't help him avoid anything, the Bahamas does have an extradition treaty with the US, so if US regulators charged him with a crime, the government in the Bahamas would arrest Sam and put him on an airplane.  Most seem to believe he's 'obviously guilty' - so why hasn't he been extradited?

But his parents weren't his only source for guidance...
Gary Gensler is the head of the US Securities and Exchange Commission. A man named Ryne Miller was Gensler's lead counsel at his previous role as CFTC Chairman.

Ryne Miller has been working at FTX for a little over one year - now he's their general legal council.

"His industry expertise and leadership will be critical as we forge cooperative working relationships with U.S. regulators" FTX said in an official press release at the time. In that same statement, Ryne Miller confirms he will be "working alongside U.S. regulators" for FTX's benefit.

These are the people who helped make sure the US branch of FTX stayed completely separate from FTX International...
FTX international is registered in Antigua and Barbuda, a small island with no capital gains tax, no wealth or inheritance taxes, and no personal income tax.

In every interview Sam has stated that the US version of FTX could open up to users immediately, and they will find all of their funds there untouched. If true, it's likely Sam violated no US laws.

If only his non-US company broke any laws, and none of it's victims were US citizens - the US justice system isn't interested.

Innocent in the only jurisdiction that matters - and that is how Sam stays out of prison...

Unfortunately, internationally, anything goes.  There is no organization that would take the lead on a case like this. There is no International police force that investigates financial crimes, and no International court for white-collar criminals.

All Sam has to do is not set foot in any of the countries with laws he violated, with citizens who had funds in FTX international, and Sam remains a free man... probably.

One Remaining Risk...
One thing Sam and those advising him may have not planned for was how big of a story this has become, and the pressure this could put on people, including those he thought were on his side. 

It's important to keep in mind how past high-profile villains who managed to anger the public were eventually taken down.

Mafia leaders were often arrested for tax violations.  More recently, disgraced Therenos CEO Elizabeth Holmes, who raised billions for a 'revolutionary' blood testing device that never worked wasn't arrested for spending years promoting her fake invention - she's in prison for wire fraud.

When powerful people in government really want to lock someone up, they find a way...
Someone like Sam, whos legitimate business involves international transactions, seeking investors, receiving investments, operating websites, etc, has probably violated the law. 

It could have been done unknowingly, or by mistake - but that doesn't matter when investigators with warrants giving them access to everything are digging for anything they can use. 

Are there any signs that the US government is attempting to build a case against Sam?
There may be, but note that the following is pure speculation.   Sam's former girlfriend, Caroline Ellison, who he appointed Alameda Research CEO has reportedly left Hong Kong for the US, and was  spotted yesterday in New York City.

A twitter user recognized her and snapped a picture of her inside a coffee shop.

This coffee shop is a short walk from the FBI's New York office - causing some to speculate if those around Sam are being offered immunity from any potential future charges, in exchange for sharing what they know as they attempt to find something to charge him with.

While it does appear to be Caroline, she may be in NYC for some other reason. Or she could be there to speak to the FBI and still have nothing to offer them.

Just saying - don't get your hopes up.

Will investors start to see Bitcoin a place to avoid volatility? It's a question unreal to ask, but there's legitimate reasons to.

A Long-Gone Ethereum Co-Founder Speaks Out - The DANGER of Ethereum 2.0...


While no longer part of the Ethereum Foundation, Anthony Di Iorio was one of the developers behind Ethereum when it launched in 2015. While he has since moved on to other ventures, he resurfaced this week, sharing concerns on ETH 2.0 in an interview

These concerns revolve about the level of centralization that Ethereum could reach now that the merge to Proof of Stake is complete.

Di Iorio's concern revolves around the possibility of major exchanges becoming an overwhelming number of the total validators on the network. 

At the root of the issue is the requirement to hold 32 ETH to launch a node -so exchanges holding thousands of ETH have an obvious advantage...

That's a little over $42,000 worth of Ethereum at the time of publishing - and it is reasonable to say this prices out the average person, who previously could have started mining for under $1000 if they were interested in contributing to the network. 

So\when the rule is "More ETH = more nodes" you immediately see the potential power major exchanges have by holding thousands of users Ethereum. Even many mid-size exchanges hold enough to launch hundreds of nodes.

However, users need to agree to use any ETH that they actually own, exchanges cannot decide how to allocate your holdings without permission.

So they're getting user permission by offering to share the profits - this factor is the reason many people see these nodes as decentralize.The nodes may be initially launched by an exchange but they're made from the Ethereum of many different people, the exchanges just brought them all together.

More importantly, all these people have the power to pull out whenever they wish. 

Can these really be considered exchange-owned nodes if their users have the power to shut them down by collectively pulling out?

Still, ETH 2.0 is off to a more centralized start than many expected.  Last week nodes launched by just 2 addresses were validating 46% of total transactions.  One is a known pool, the other an 'unknown entity'... which nobody likes to hear. 

The move away from GPU mining is a double-edged sword when it comes to decentralization...

It may not be as simple as looking at who now has an easier entry to becoming a validator, but for a large number of people, Ethereum's update represents a door opening.

On that note, Di Iorio also acknowledged that the Proof of Stake model allows people from countries that have banned GPU mining to participate again (such as Algeria, Bangladesh, Bolivia, China, Colombia, Egypt, Indonesi and more) many of them pointing to the large amount of electricity consumed by miners as their reasoning, an issue the new Ethereum now solves.

The FREE Coin All Ethereum Holders Get Once Ethereum 2.0 Goes Live...

So it's confirmed - A group of developers are working behind the scenes with Ethereum miners to hard fork the Ethereum blockchain after next week’s merge. This means there will still be a version of the network running on the current Proof-of-Work (PoW) consensus mechanism while the 'official' Ethereum 2.0 blockchain transitions to Proof-of-Stake (PoS).

With that comes a separate and completely independent Ethereum token, currently being called 'ETHPoW' but the coin's official name is still undecided. 

All Ethereum holders will receive ETHPoW automatically, an amount equal to the regular Ethereum you hold...

Major exchanges Binance, MEXC Global, Gate.io, and FTX have already agreed to list and support trading of the forked token. Poloniex is even a step ahead of the rest, and has already listed a placeholder token that will be swapped for the real thing once it's live.

Coinbase and Kraken both say they're open to supporting it, but haven't yet made a full commitment, likely waiting to see if the coin will have any demand or value.

ETHPoW will join the two existing Ethereum tokens - the 'official' Ethereum (ETH) and Etherum Classic (ETC)...

The upcoming 2.0 fork won't be Ethereum's first, the previous fork ended with two coins and two versions of Ethereum - Ethereum and Ethereum Classic. 

To summarize what happened then - in 2016, hackers exploited a security hole in a project called 'The DAO' allowing them to steal about $50 million worth of ETH. A solution was proposed to re-launch Ethereum with the history of the hacked coins completely erased, like it never happened.

How they went about doing this caused a lot of controversy, it was all decided when the proposal was put to a short notice on-chain vote. Only 5.5% of potential voters participated, but since the majority of them voted 'yes', the fork happened.

Those in the Ethereum community who disagreed with the decision simply ignored the change and continued to participate on the original Ethereum network, which became known as Ethereum Classic. 

While Ethereum Classic is considered one of the most successful forked tokens, ETHPoW's Success is far from a 'sure thing'..

When Ethereum Classic started, its support, in large part, came from the controversy that created it.

Some in the community strongly disagreed with the idea of editing the 'true' history of the Ethereum blockchain, and Ethereum Classic kept that intact. Others disagreed with how the decision to fork the coin was made, saying they would support any decision that had over 50% of potential voters backing it, but the fork went ahead without even coming close.  

Ethereum Classic succeeded, and is still active today, because the people behind it truly believed in it.

But when it comes to Ethereum 2.0 - it isn't controversial, it doesn't violate the beliefs of a large portion of the community.  

The only segment of the community united against 2.0 are miners, because once Ethereum has fully moved to the 2.0 Proof-of-Stake consensus mechanism, miners are no longer needed to verify transactions. Their motivation to continue supporting the old version of Ethereum is entirely profit-based. These are the same miners who loved it when we couldn't send $1 on the Ethereum blockchain without paying a $75 fee.

That just doesn't sound like the beginning of a token that will have long term success.

Take a look at the two most successful forks in crypto's history - Ethereum Classic and Bitcoin Cash. All others have faded away, while these two remain in the top 50 because they're backed by a community of supporters who believe their existence is important. You can find their supporters making passionate arguments on where they think the 'official' version of the coin went wrong, and why these alternatives make things right.

This is why dumping ETHPoW as soon as possible may end up being the smartest move... 

There already is an Ethereum alternative for anyone who doesn't want to support the 'official' version - Ethereum Classic. It's already accomplished the hardest part - establishing itself among the small list of coins traders can trust to retain value, and can be found on every major exchange. 

There just isn't a good reason for another alternative - maybe the Ethereum brand is big enough where it finds support even if it isn't necessary. But even forks of Bitcoin that every Bitcoin holder received for free met a quick death, because people didn't believe they needed to survive. 

How to make sure you'll be able to access your ETHPoW as soon as it becomes available...Typically the day forked coins go live, is the day they have the highest value, so if you're aiming to be among the first to trade yours, you'll want to transfer any Ethereum you own off of any exchanges and on to a wallet like Metamask, where you hold the private keys.  

Once it launches, you'll be credited an equal 1:1 amount of ETHPoW for any Ethereum you own, and will be able to access it in the same wallet that holds your regular Ethereum. You'll need to switch networks (blockchains) and we'll make sure to post the settings you'll need as soon as that becomes known. 

If your Ethereum is on an exchange they will need to take several additional steps to distribute each users portion, this is because they store multiple users coins together. In the past, some exchange users waited weeks or even months longer than those holding crypto in their own private wallets.

Bitcoin's Gains TWICE As Strong as S&P500 and NASDAQ...

Both the stock and cryptocurrency markets are reacting to today's news that US Federal Reserve will increase interest rates by 0.75%.  The measure is aimed at controlling inflation, which remains at its highest levels since the early 1980s, and is seen as evidence that the maintains flexibility and hasn't felt the need to implement more drastic measures, at least yet.

Fed Chairman Jerome Powell pointed out that there are recent indicators that both consumption and production have decreased, but added that the unemployment rate has remained low and that job growth in the first half indicates that we are not in a recession. 

Bitcoin and Stocks on The Rise, But Bitcoin is Outpacing Both Major Indexes...

Following the news Nasdaq gained about 4%, the S&P 500 gained around 2.5%, and Bitcoin surpassed both easily with gains of over 8% at the time of publishing.

CoinBase among stocks to outperform market average...

The company needed a good day following a 21% loss yesterday, today they gained half of that back. 

It's been hell-week for Coinbase - first came news that SEC is closely monitoring Coinbase's operations to determine if the exchange has allowed its users to trade tokens that could be considered unregistered securities. Coinbase denied that it lists securities for trading and stated on its blog that it reviews "every digital asset before it is made available on our exchange, a process that the SEC itself has reviewed."

Then ARK Investments, managed by Cathie Wood, dumped $658 million worth of Coinbase shares, removing it entirely from their portfolio.

They end the day at $58.49 - still, the overall picture isn't great when taking in to account that they launched April 2021 at $400. 

But remember - a return of the crypto bull market and setting a new Bitcoin all time high could send Coinbase back to the $300-$400 range shockingly fast, as their holdings triple in value and increased trading activity would once again have them making millions in exchange fees.

Bitcoin Miners STILL EARNING After Orders to SHUT DOWN During Texas Heatwave...

It's summer time and nobody is feeling it more than Bitcoin miners, specifically those in the US. Already known for the heat output caused by masses of GPU's, each mining rig has a dedicated fan there to draw heat away from expensive components. On top of that, every big mining operation has some additional method to cool it down. 

In areas with cheap power, air conditioning is often the second line of defense. Others add huge industrial fans to work with the hundreds of smaller ones. But the cheapest solution for the heat comes from miners in Siberia, where temperatures are often below zero and opening the windows is all it takes to cool down a warehouse full of mining rigs.

But for those who aren't willing to relocate to freezing remote corners of the earth to mine Bitcoin, there's the state of Texas in the US.  Many mining operations from other US states have relocated there, and it has become the top destination for miners leaving China following their ban on it last year.

When Texas Gets Hit With a Heat-Wave, Miners Go Offline - By Choice...

In a deal with the Electric Reliability Council of Texas (ERCOT), the companies setting up in the state have agreed to power down when energy usage spikes on hot days due to residents and businesses turning up their air conditioning. 

There isn't a hard choice to make here - if the miners didn't pause their activity for a few hours, the state would begin to experience blackouts as the grid becomes overwhelmed - so the miners end up offline either way. But working with the electricity providers to do this voluntary means the mining staff can at least wait it out in a nice air conditioned building.

We knew this much a couple months ago, when we covered the agreement for miners to power down - but that was just half the story.

Just Because They Aren't Mining, Doesn't mean they aren't earning...

Yes you read that correctly. 

That agreement with the Electric Reliability Council of Texas includes a special arrangement: every time a mining company is asked to shut down to save power, it will be structured the same as if these mining companies were producing and selling energy back to the grid.

Miners buy power contracts in advance at standard rates, but any time they are shutting down and 'selling' power back, they're selling it at higher peak-usage prices. Some estimate that earnings from powering down could come to 10% a miner’s yearly income.

Surprised and impressed at the deal miners were able to get from the state, I spoke with someone I met at an industry conference in 2019 who moved his mining business to Texas in 2021. Is there something we're missing here? Or is the deal really that good?

He explained, "LOL yeah, the deal really is that good. I'm not blowing smoke when I say TX is where it's at if you're on the mining end of the industry. If I had to come up with something negative, it would be how I can't help but wonder how long we can count on the state for this extra support. Everyone in crypto faces the risk of people electing tech-illiterate boomers who don't understand crypto thinking they need to re-write the rules for it. They'll say, 'These guys should be paying more, not making a profit' and we'll say 'goodbye' and relocate to Florida, which is currently the second best place to mine bitcoin."

So WHY would Texas give Miners such a good deal? 

The miners, as well as politicians who support incentivizing them to come to their state, point out that this is speeding up the expansion of wind, solar, and other renewable power capabilities - moving the state away from coal faster than they originally thought was possible.

Those who invest in and build renewable energy resources can just go ahead and build, knowing the energy they produce will be immediately sold, thanks to the miners.

An industry having a steady demand for energy is only beneficial if they can stop that demand when needed to share with the state - and crypto uniquely has this ability. Unlike a factory or oil refinery, crypto miners can cut their electricity usage in seconds, bringing instant relief to an overloaded grid.

A former operations manager for the state grid, Carrie Bivens says "a very special kind of demand; it can curtail very quickly."

In large part because of Texas's energy policies, the US holds the #1 position of all countries when it comes to Bitcoin mining, with approximately 38% of it occurring there. All other nations come in at 20% or under.
