SEC Isn’t Feeling Confident About Their Ripple Lawsuit

SEC isn’t feeling confident these days re: Ripple lawsuit. 

The neverending Ripple lawsuit has been raging for over a year now. This, despite the fact that confidence is wavering at the U.S. Securities and Exchange Commission (SEC) — at least according to some unnamed sources.

  • “Turns out even staff at the @SECGov aren’t confident they will win the case against @Ripple. A source close to the SEC tells me @HesterPeirce has expressed privately she thinks the SEC will not get the outcome it’s looking for,” said Eleanor Terrett from Fox Business. 
  • Hester Pierce is a commissioner at the SEC, however, she’s a crypto-friendly one — known colloquially as crypto mom.
  • She hasn’t spoken directly on the Ripple lawsuit, but previously said, “I don’t want to speak to any particular cryptocurrency, whether it’s in litigation with us or not in litigation with us. But I think everyone has to look at the facts and circumstances.”
  • Despite the lawsuit appearing to not have universal support inside the SEC, and confidence fading in it, the proceeding still goes on. The SEC first launched the lawsuit back in December 2020.
  • The lawsuit accuses Ripple of offering unregistered securities in the form of their XRP token.
  • “We’re seeing pretty good progress despite a slow-moving judicial process,” CEO of Ripple Labs Brad Garlinghouse told CNBC back in December. The CEO expects the proceedings to end sometime in 2022.
